Georgia House Bill 1315 Seeks to Limit Local Development Moratoria

Frustration over frequent local development and zoning moratoria has led to the introduction of new legislation aimed at curbing their use. House Bill 1315, the “Georgia Landowners Protection Act,” would amend Georgia’s zoning procedures law to place firm limits on how long local governments can halt development.

The bill caps most moratoria at 180 days and prohibits similar or renewed moratoria for at least 365 days after expiration—effectively ending “rolling” pauses. It also requires 30 days’ public notice before adoption and provides exceptions for emergencies such as natural disasters or threats to public health and safety.

Supporters argue that extended permitting and zoning delays drive up housing costs and prevent property owners from making viable use of their land. A key provision partially waives sovereign immunity, allowing property owners to sue local governments if a moratorium exceeds 180 days and causes financial harm.
